If you hold a property jointly with another person with rights of survivorship, that property will pass to you upon the other person’s death. However, it is not possible to avoid probate court completely. An estate tax return will need to be filed within six months of the death, and the probate court’s intervention may be required to get a release of any tax lien on the property.
