Students with Disabilities in Private Schools

In early 2022, the United States Department of Education’s Office of Special Education Programs (OSEP) came out with a Q&A style guidance for students with disabilities who were placed in private school by their parents. The guidance states that these children fall into one of three categories:

  • placed by their parents, not enrolled in the LEA (Local Educational Agencies), and do not have an issue being provided a FAPE (Free Appropriate Public Education);
  • placed by their parents, are or previously were enrolled in the LEA, and do have an issue being provided a FAPE; and
  • placed by the LEA to ensure that a FAPE is available

The purpose of this document is give the individuals who fall into the first category listed above an understanding of the IDEA (Individuals with Disabilities Education Act) requirements that apply to them.
