“The U.S. Congress has defined “educational records” as records, files, documents, or any other materials that:

  1. contain information related to the student; and
  2. are maintained by an educational institution or by a person acting on behalf of such an
    institution.”

Under the Family Educational Rights and Privacy Act (FERPA), “a record that teachers or other school employees maintain in their sole possession is not considered an educational record. In addition, records of law enforcement authorities in the school, records of a student who is 18 years or older that are maintained by a physician, psychiatrist, psychologist, or records in connection with the treatment of a student, do not fall under the definition.”
